Terms and Conditions

  1. Nothing in these terms and conditions will affect a player's statutory rights.
  2. References to the House or DuskTillDawn in the terms and conditions relating to the English Poker Open (and/or any part of it) (the "Event") shall mean DUSK TILL DAWN LTD
  3. The House may at anytime and at its sole discretion reject any player's application to participate in the Event and/or refuse any player access to the Event for any reason including but not limited to if the House believes that a player's participation in the Event will in any way damage the Event, cause any loss or liability in relation to the Event for the House and/or any third parties.
  4. Each player expressly agrees that by entering the Event s/he is authorised to enter the Event by law and by registering for the Event, each player agrees that s/he will be bound by the terms and conditions relating to the Event which are set out on the House's website at www.dusktilldawnpoker.com as may be amended, modified or changed from time to time by the House (the "House's website").
  5. Each player agrees that s/he will be solely liable for paying all taxes and duties that relate to any monies that s/he obtains as a result of playing in the Event.
  6. Each player agrees that s/he:
    1. will promptly follow all of the instructions of the House in relation to entering and participating in the Event;
    2. will provide all such information, co-operation and assistance as the House may require from time to time in relation to their participation in the Event; and
    3. will not do anything or omit to do anything which give rise to or lead to any legal liability of whatever nature being suffered or incurred by the House (and/or any third parties) in relation to the Event (apart from in relation to any monies won or lost by a player from playing poker in the normal and ordinary course of the Event).
  7. English Poker Open is a trade mark of Armchair Partners Limited and is used by the House under licence from Armchair Partners Limited. All goodwill and rights relating to English Poker Open shall belong to and vest in Armchair Partners Limited. All rights relating to the English Poker Open trade mark are reserved by Armchair Partners Limited.
  8. THE HOUSE MAY AT ANY TIME CHANGE THE DETAILS AND FEATURES OF THE EVENT AT ITS SOLE DISCRETION AND WILL ADVERTISE SUCH CHANGES ON ITS WEBSITE AS SOON AS REASONABLE PRACTICABLE. Such change may include but not be limited to the dates upon which the Event is to be held, the venue at which the Event is held, the number of players that are allowed to enter the Event, the amount of the entry fees and buy in stake, the catering arrangements, the number of seats/players per table, sponsorship arrangements and television deals (if any) and/or any other matters which the House in its sole opinion deems is necessary or desirable in relation to changing details or features of the Event. The House will endeavour to email each registered player with any major and material changes to the Event as soon as reasonably practicable following any such changes being made by the House. IF THE HOUSE CHANGES THE DATE(S) UPON WHICH THE EVENT IS TO BE HELD, THE COUNTRY IN WHICH THE EVENT IS TO BE HELD OR THE ENTRY FEES AND BUY IN STAKE TO THE EVENT AFTER A PLAYER HAS ALREADY REGISTERED THEN A PLAYER MAY, WITHIN 7 DAYS OF THESE DETAILS BEING CHANGED ON THE HOUSE'S WEBSITE, BE ENTITLED TO EMAIL THE HOUSE TO CANCEL THAT PLAYER'S REGISTRATION AT THE EVENT AND TO REQUEST A REFUND OF THE MONIES WHICH THAT PLAYER HAS ALREADY PAID TO THE HOUSE IN CLEARED FUNDS IN RESPECT OF THAT PLAYER'S ENTRY TO THE EVENT.
  9. BY ENTERING AND/OR PARTICIPATING IN THE EVENT YOU AGREE THAT THE HOUSE MAY USE YOUR PERSONAL DATA (INCLUDING BUT NOT LIMITED TO YOUR BIOGRAPHY, PERSONAL DETAILS AND PHOTOGRAPHS) AS IT DEEMS NECESSARY OR DESIRABLE IN CONNECTION WITH THE PROMOTION, HOSTING, PLANNING AND RUNNING OF THE EVENT AND AFTER EVENT ACTIVITIES INCLUDING BUT NOT LIMITED TO PUBLICISING IN ANY WAY THE EVENT, THE WINNERS AND DETAILS ABOUT THE EVENT.
  10. EACH PLAYER AGREES THAT BY ENTERING AND/OR PARTICIPATING IN THE EVENT THAT THE HOUSE MAY KEEP AND MAINTAIN THAT PLAYER'S DATA AND CONTACT THAT PLAYER IN RELATION TO THIS EVENT AND ONGOING PROMOTIONAL EVENTS OR ACTIVITIES (INCLUDING BUT NOT LIMITED TO KEEPING EACH PLAYER UPDATED ON SIMILAR EVENTS TO THE EVENT).
  11. EACH PLAYER AGREES THAT BY ENTERING AND/OR PARTICIPATING IN THE EVENT, EACH PLAYER'S DETAILS MAY ONLY BE DISCLOSED AND TRANSFERRED BY THE HOUSE TO ARMCHAIR PARTNERS LIMITED AND THE ASSOCIATED COMPANIES OF ARMCHAIR PARTNERS LIMITED AND ANY OF THESE ORGANISATIONS MAY CONTACT THE PLAYER FROM TIME TO TIME WITH INFORMATION., OFFERS, PROMOTIONS AND/OR EVENT DETAILS THAT ARMCHAIR PARTNERS MIGHT BE INVOLVED WITH OR WHICH ARMCHAIR PARTNERS LIMITED BELIEVES PLAYERS MAY BE INTERESTED IN.
  12. ARMCHAIR PARTNERS LIMITED MAY ALSO KEEP AND MAINTAIN THIS PLAYER DATA AND TRANSFER THIS PLAYER DATA (AND/OR ANY PART THEREOF) TO ANY PURCHASER OF THE ASSETS OR SHARES IN ARMCHAIR PARTNERS LIMITED (AND SUCH PURCHASER MAY USE SUCH PLAYER DATA IN A SIMILAR WAY TO THE WAY IT WAS BEING USED BY ARMCHAIR PARTNERS LIMITED).
  13. The House reserves the right to modify, change or add to these terms and conditions at any time. All changes will be published at the House's website and upon such publication each modification, change or addition will become effective and each player will be deemed to be aware of and bound by any changes to these terms and conditions. It is each player's responsibility to read, understand and regularly consult with the House's website and these terms and conditions.
  14. Each player cannot cancel any entry unless this is done prior to 1st September 2009 and no refunds will be provided to any players which cancel their entry after 1st September 2009 or to any players who do not attend the Event (for whatever reason).
  15. By entering and participating at the Event you hereby agree that you likeness, image and biography may be used by the House as the House deems necessary or desirable in relation to any television, internet or other coverage, advertisement or promotion of the Event from time to time.
  16. Players are permitted to wear sponsors logos on their shirts or a cap/hat. These logos will be no larger than 10cm * 7.5cm (on the shirt or headwear) and no larger than 8cm * 3cm on each sleeve. No more than 2 logos per shirt. All logos and promotional material/text for any dot.net website must contain a clear and visible “dot.net” suffix at least the same size as the site name.
  17. Players may wear sunglasses, hats or other headgear provided the players' speech and ears are visible.
  18. Players may not wear earphones when seated at the featured/final tables
  19. No other branding on any part of their body or clothing will be permitted.
  20. Players' general appearance and sponsors shirts must be neat and clean. T-shirts will be permitted at the final table as long as they are deemed to be neat and clean. Sponsors must be aware that their players will not be allowed play on the feature table in unsuitable clothing. Tournament Organiser's decision will be final. Substitute shirts will be provided if available.
  21. Players may be sponsored for the event. Under no circumstances may players at the taped featured/final tables add logos or promotional material/language to their clothing after the beginning of the that day’s session of play.
    Also under no circumstances will any logo, message, patch or promotional language be permitted that the House determines:
    1. Contains any false claims for any product or makes any claim that the House in its final view considers unethical
    2. Advertises any non-prescription or non over-the-counter drug, pornographic site or contains any material that is obscene, profane, vulgar, repulsive or offensive or refers to matters that are not considered socially acceptable topics
    3. Belittles or libels any person or product
    The House reserves the right at all times to impose a ban on any clothing/cap etc deemed objectionable by the House at its sole and absolute discretion.
  22. DTD and the Tournament Director’s decision will be final on what clothing complies with the above rules and reserve the right to refuse entry or continued participation in any of the events to a player who does comply with the tournament clothing rules.
  23. Players also consent to participating in all reasonable requests for interviews and photographs surrounding this event. Publicity will be used in press releases and on AGL sites to promote the English Poker Open. Winners of events at the English Poker Open will be required for future publicity of the English Poker Open.
  24. Players at the featured/final table must agree to disclose their hole cards to the under the table cameras and any refusal to do so could lead to disqualification from the event with no prize money being awarded and no refunds given.
  25. DTD reserves the right to add or amend any tournament rules, as they feel appropriate
  26. Players must be appropriately dressed at all times within the main arena and will not be permitted to play if dressed in a manner deemed distracting to other players. The Tournament Director & DTD reserve the right to refuse participation of any players that does not abide by this rule
  27. NOTHING IN THIS AGREEMENT SHALL EXCLUDE OR LIMIT THE HOUSE'S LIABILITY FOR DEATH OR PERSONAL INJURY DUE TO ITS NEGLIGENCE, FOR FRAUD OR FOR ANY OTHER MATTERS TO THE EXTEND THAT THIS CANNOT BE EXCLUDED OR LIMITED BY LAW.
  28. THE HOUSE HEREBY EXCLUDES ITS LIABILITY (AND THAT OF ITS AGENTS, OFFICERS, EMPLOYEES AND THIRD PARTIES WHICH WORK ON ITS BEHALF AND ALSO ARMCHAIR PARTNERS LIMITED) FOR CONSEQUENTIAL, INDIRECT OR SPECIAL DAMAGES OF WHATEVER NATURE AND HOWSOEVER ARISING IN RELATION TO THE EVENT.
  29. THE HOUSE HEREBY EXCLUDES ITS LIABILITY (AND THAT OF ITS AGENTS, OFFICERS, EMPLOYEES AND THIRD PARTIES WHICH WORK ON ITS BEHALF AND ALSO ARMCHAIR PARTNERS LIMITED) FOR ANY LOSS OF PROFITS (WHETHER DIRECT OR INDIRECT), LOSS OF GOODWILL OR REPUTATION, LOSS OF OPPORTUNITY, LOSS OF ANTICIPATED SAVINGS AND/OR LOSS OF TIME OR DELAYS OR INTERRUPTIONS IN RELATION TO THE EVENT.
  30. THE HOUSE (AND ITS AGENTS, OFFICERS, EMPLOYEES AND THIRD PARTIES AND ARMCHAIR PARTNERS LIMITED) LIMIT THEIR TOTAL MAXIMUM AGGREGATE LIABILITY TO EACH PLAYER TO THE AMOUNT OF MONEY WHICH THAT PLAYER HAS PAID IN CLEARED FUNDS TO THE HOUSE FOR THAT PLAYER'S ENTRY FEE AND THE BUY-IN STAKE WHICH ENABLES THAT PLAYER TO PARTICIPATE IN THE EVENT.
  31. EXCEPT AS EXPRESSLY PROVIDED FOR IN THESE TERMS AND CONDITIONS, THE HOUSE DOES NOT GIVE OR MAKE ANY REPRESENTATIONS, WARRANTIES OR ASSURANCES OF ANY KIND THAT THE EVENT WILL BE OF ANY PARTICULAR QUALITY, THAT IT WILL BE FIT FOR ANY PARTICULAR PURPOSE OR THAT IT WILL BE CONDUCTED IN ANY PARTICULAR MANNER, STYLE OR FORMAT OR TO ANY PARTICULAR TIMETABLE.
  32. IF THE EVENT IS CANCELLED, ABORTED, POSTPONED OR RE-SCHEDULED FOR ANY REASON THEN THE TOTAL MAXIMUM AGGREGATE LIABILITY OF THE HOUSE (AND ITS AGENTS, OFFICERS, EMPLOYEES AND THIRD PARTIES AND ARMCHAIR PARTNERS LIMITED) TO EACH PLAYER SHALL BE THE AMOUNT OF MONEY WHICH THAT PLAYER HAS PAID IN CLEARED FUNDS TO THE HOUSE FOR THAT PLAYER'S ENTRY FEE AND THE BUY-IN STAKE WHICH ENABLES THAT PLAYER TO PARTICIPATE IN THE EVENT.
  33. EACH PLAYER AGREES THAT S/HE HAS RELIED UPON THEIR OWN SKILL AND JUDGEMENT WHEN ENTERING AND PARTICIPATING IN THE EVENT AND THAT THEY HAVE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ENTERING AND PARTICIPATING IN THE EVENT.
  34. The House and each and every player agree that the Contracts (Rights of Third Parties Act) 1999 is hereby excluded to the maximum extent permitted by law PROVIDED that this agreement may be enforced against any party by Armchair Partners Limited and any companies or organisations which are related to or associated with Armchair Partners Limited from time to time including but not limited to Armchair Partners Limited's group companies.The House may in its discretion elect to pay prize money to players by electronic funds transfer, and may require players to provide bank account details for this purpose.  The House may require a player to provide alternative bank account details if the account details provided relate to an account within a jurisdiction to which money transfers are prohibited or restricted by any laws, rules, regulations and/or guidelines which apply to the House and/or its bankers.
  35. Any claims, demands, actions or proceedings (of whatever nature and howsoever arising) in relation to the Event shall be taken or brought by any player against the House alone (and not against any third parties).
  36. In the event that any provision of these terms and conditions is held for any reason to be void, voidable or unenforceable then this shall not affect the validity or enforceability of any other provision of these terms and conditions or of the remainder of these terms and conditions.
  37. The House is licensed to operate the Event under the relevant gaming laws.
  38. The terms and conditions on the House's website form the entire agreement between the House and each player in relation to the Event and supersede and replace all prior agreements, arrangements, warranties, representations, understandings and/or courses of trade or business in relation to the Event (Prior Agreements). Each player agrees that it is not relying upon any Prior Agreements in relation to the Event except to the extent that these are expressly set out in writing in these terms and conditions.
  39. THE HOUSE (AND ITS AGENTS, OFFICERS, EMPLOYEES AND THIRD PARTIES AND ARMCHAIR PARTNERS LIMITED) SHALL NOT BE LIABLE FOR ANY EVENTS OR MATTERS RELATING TO THE EVENT WHICH ARE BEYOND THEIR REASONABLE CONTROL (INCLUDING BUT NOT LIMITED TO ANY WAR, RIOT, STRIKE, POWER FAILURES, PROBLEMS WITH TRANSPORTATION, ANY CHANGES TO THE LAW THAT MAY AFFECT THE EVENT, PROBLEMS OR DEFECTS WITH TELECOMMUNICATIONS NETWORKS, COMPUTERS, THE INTERNET AND/OR IT SYSTEMS OR PROBLEMS WITH POWER SUPPLIES, ANY ISSUES DUE TO ACTIONS OF PLAYERS AT THE EVENT OR ARISING FROM ACTIONS OF PLAYERS AT THE EVENT, ANY ACTIONS OF ANY THIRD PARTIES AND/OR ANY PROBLEMS IN OBTAINING MATERIALS OR SUPPLIES).
  40. References to "terms and conditions" herein shall include but not be limited to these legal terms and conditions and also the terms and conditions listed under the Tournament Rules (i.e. under the headings General, Competition Policies, Competition Procedures, Registration and Cancellation Policy and Satellite Qualifiers) (to the full extent to which these may apply to the Event) and also terms and conditions which may relate to this Event which are set out on the House's website.
  41. These terms and conditions shall be governed and construed in accordance with English Law and the House and each and every player submit to the exclusive jurisdiction of the English Courts for all matters relating to these terms and conditions.
